Pre-nuptial Agreements

Whilst it has long been possible for those contemplating marriage to agree what should happen in the event of their relationship breaking down, the Courts in England and Wales have been irratic in the attachment of weight to such agreements.  However, in recent decisions, the Courts appear to be prepared to give significantly more weight to these "pre-nups"/ "ante-nups".

As a consequence, pre-nuptial agreements may now be of more value to couples seeking to regulate their affairs prior to marriage. Our team would be happy to assist in identifying the steps that you should take, and if required, draft the necessary agreement to give that agreement the best chance in being enforceable if the unfortunate necessity arises.

Cohabitation

It is a common misconception that co-habiting couples have similar rights to those who marry. In reality, cohabitees are largely unprotected by the law. However, with our assistance there are steps you can take to ensure that if the worst should happen, everyone will know what to expect.

We strongly recommend that if you are planning to live with someone, particularly if you are buying a property or intend to have children, you should obtain legal advice before you do so.

How can we assist you?

Once you have decided to live together we can assist you in drawing up a Cohabitation Agreement setting out arrangements regarding your life together including establishing your rights should the relationship breakdown. Examples of matters that can be included in a Cohabitation Agreement are:

  • Ownership of property
  • Finances - i.e. the division of bills or ownership of joint accounts
  • Children
